Gulf Insurance Group/Jordan, a duly registered a public listed shareholding company in the Hashemite Kingdom of ‎Jordan, holding national number )200001238) (“we”, “our”, “us”, “GIG/Jordan”)‎ is dedicated to providing insurance services, we operate the websites located at (https://www.gig.com.jo) and other products, services, and mobile applications with links to these Terms and Conditions (“Terms and Conditions”), including without limitation (GIG-JORDAN application) (collectively, the “Site(s)”, “Website(s)”, “Online Channels”, and/or “App(s)”, unless otherwise specified). Users of the Sites and/our customers of our Online Channels/purchaser of the Insurance Policies are referred below as “Users”, “Customer(s)”, “you”, “your”, or “yours” as the case may be.

1.Definitions

 

  • Content: means any text, graphics, audio, video, software, data, and/or any other form of information that appears on our Online Channels.
  • Online Channels: means any of our selling channels whether our website, mobile application, or any other channel approved by us officially.
  • Insurance Policy: means any insurance policy issued by us electronically through our Online Channels, including medical, travel, motor, domestic or home assistance or property insurance policies.
  • Intellectual Property: shall include, without limitation, any inventions, discoveries, designs, know-how, processes, business methods, patents, trademarks, copyrights, computer software, ideas, creations, writings, photographs, motion pictures, whether in hard copy or electronic form.

 

2.Acceptance of Terms and Conditions and its Modifications

By using our website(s), mobile application(s), and Online Channels, you agree to these terms and conditions, our Privacy Policy, and any other published policies. This agreement is legally binding. If you do not accept any part of these terms, do not use our Online Channels or purchase insurance policies through them. We reserve the right to modify or update these terms, the Privacy Policy, and other policies at any time, and it is your responsibility to periodically review the most current terms. Your continued use of our Online Channels after any changes constitutes acceptance of those changes.

Where visiting or using the Website, your information will be processed by GIG/Jordan for the purposes stated in the Privacy Policy, where applicable and legally permissible.

3.Our Services through the Website(s)

Through our Online Channels, we are honored to offer and provide the issuance of insurance policy by us digitally, including but not limited to issuing medical, travel, motor, domestic or home assistance, property insurance policies, medical claims processing, and/or other services as GIG/Jordan finds adequate (“Insurance Services”) subject to the Terms and Conditions mentioned herein, GIG/Jordan’s internal policies relating to such Insurance Policies, and the Insurance Policies wording as the case may be. Some Insurance Services might be modified, added, removed, suspended or omitted from the Website(s) and/or the Application for all, some, or one of the Customers upon our own discretion. ‎

Notwithstanding the above, we reserve the right to reject any order to purchase any Insurance Policy, refuse to renew an insurance policy, limit the insurance coverage, or differentiate regarding insurance prices, terms, or coverage benefits, provided such actions are justified by technical or actuarial reasons, or based on prior experience or an established relationship with the client, or other.

The terms and conditions of the relevant Insurance Policy shall be applied in relation to terminating and/or amending the relevant Insurance Policy.

If we conduct any marketing campaign through the Online Channels, you will be deemed to have accepted the terms and conditions of the said campaign by your continuous use of our Online Channels and being provided with Services relating to such campaign. We reserve the right, at our sole discretion, to make changes or modifications to the terms and conditions of this campaign for any reason and at any time without any liability towards you whatsoever. We also reserve the right, at our sole discretion, to terminate/ remove/ suspend and/or make any amendments to such campaign for any reason and at any time without any liability towards you whatsoever.

4.Submitting Applications and Account Registration

In order to use some of the provided services by us, including -but not limited to- insurance services, you must submit an order, and/or registering on our Website(s)/App relating to the desired insurance service(s) and agree to these Terms and Conditions.

In order to be provided with our service(s) through our Online Channels, you must be of the legal age to enter into a contract. If you are not legally able to enter into a contract, you must get your parents’ permission and ensure that they have read and agreed to these Terms and Conditions. If you are under 18, some services may not be available to you without parental involvement and confirmation.

5.Representations and Warranties

By using our Online Channels, you represent and warrant that: (a) all personal information provided by you is true, accurate, complete and correct, and you will maintain the accuracy of such information and promptly update us of any change as necessary; and (b) you have the legal capacity to agree and comply with these terms and conditions. You agree to notify us of any changes to your mobile number and update your account(s) to reflect this change. You agree that we may send you limited personal information by email, SMS, and mobile telephone notification.

In case any of the personal information provided by you has been found to be untrue or inaccurate or incomplete, we reserve the right to terminate these Terms and Conditions immediately and/or suspend your account/your use to the Online Channels without being liable towards you.

6.Payment Terms

The Customer agrees and acknowledges that:

  • Users must pay for services through the payment process provided by GIG/Jordan. Payment details and methods will be outlined on the Website and/or App’s instructions.
  • Users agree to provide accurate and up-to-date payment information. GIG/Jordan reserves the right to suspend or terminate services if payment information is inaccurate or outdated.
  • Users understand and agree that any services will not be provided until full payment has been successfully processed. If an order to purchase an insurance policy has been made and the payment was incomplete or incorrect, your order will be cancelled automatically without notification.
  • All payments terms are subject to the Insurance Polic(ies) terms and conditions, including terms relating to refunds.
  • All prices listed under the Online Channels may be changed or modified by us from time to time. GIG/Jordan has the sole right to modify the Insurance Services fees or impose fees for any free Insurance Services as the case might be. Also, these prices are subject to be amended as per any implied fees and/or taxes by the regulatory authority(ies).
  • The cost of services, including any fees or charges, will be clearly communicated to Users during the ordering process. Users are responsible for reviewing and accepting the total cost before confirming the ordering process.
  • All Insurance Polic(ies) are subject to fees and taxes (if applicable), which shall be defined separately for each Insurance Polic(ies).
  • Users acknowledge that if payments are made through other payment service providers, the terms and conditions of those providers shall apply.

 

7.User’s Accounts and Security

You are responsible for maintaining the confidentiality of your account, order information, your information, including your password. You must promptly notify us of any unauthorized access or use of your account or orders. We reserve the right to suspend or terminate accounts and/or orders for security reasons.

8.Anti-Money Laundering and KYC

 

  • We represent that we have anti-money laundering procedures in place which comply with the applicable laws in Jordan. We will undertake the necessary legal action including notifying the relevant authorities of any suspicious activity by the Customer of which we become aware of and terminating the contractual relationship with the Customer.
  • For the purposes of complying with the ‘know-your-customer’ rules and regulations, we assume that all personal information provided by you (including ID number, passport number, residency permit number, address, telephone number) is true, accurate, correct and complete.

 

9.User’s Behavior

Users must adhere to acceptable standards of behavior within the Website(s) and/or Application.

You agree to use the Website(s) and/or Application and any provided service responsibly, and in a manner that is not: unlawful, fraud, threatening, harassing, abusive, defamatory, slanderous, libelous, harmful to minors, vulgar, gratuitously violent, obscene, pornographic, indecent, lewd, invasive of another’s privacy, or racially, ethnically or otherwise offensive, hateful or abusive. Also, You may not:

  • Promote, advertise, issue, sell or promise to sell any of our Insurance Policies posted on our Online Channels to any third party, without obtaining our prior written confirmation.
  • Misuse of the issued Insurance Policies, Website(s) and/or Application.
  • Using our Online Channels in any way which causes, or may cause damage to any of our Online Channels or in a way that is in breach of any applicable laws.
  • Using our Online Channels with the intent to impersonate another person, whether by providing us with false/fraud personal information or otherwise.
  • Access our Website(s) and/or Application in ways that could damage, disable, overburden, or impair them, or interfere with others' use. Unauthorized access to content, services, accounts, systems, or networks is prohibited. Automated means (e.g., scrapers) to access our Website(s) and/or Application are not allowed. Using another person’s login credentials or soliciting login information is a direct violation of these Terms and applicable laws.

 

GIG/Jordan does not make recommendations or endorsements.

We do not recommend or endorse any specific services, tests, doctors, products, procedures, opinions, or other information that may be mentioned on our Website(s) and/or Application.

GIG/Jordan does not guarantee the accuracy of Third Party Services.

GIG/Jordan has no editorial control over or responsibility for services provided by third parties (including payment service providers) and any opinions, statements, products or other information expressed or made available by third parties.

Our Website(s) and/or Application may contain links to third-party websites. These links are provided solely for your convenience and do not imply endorsement or approval of the content, products, or services provided by such third-party websites.

We do not control, monitor, or assume responsibility for the content, security, privacy policies, or practices of any third-party websites. By accessing third-party websites, you acknowledge and agree that we are not responsible or liable for any damages, losses, or issues arising from your use of these websites.

You are responsible for your use of our Mobile Features.

The platforms available via our Website(s) and/or Application offer features and services accessible on mobile phones, desktops, and other devices. These features include uploading content, receiving messages, downloading applications, and more (collectively, the “Mobile Features”). Standard messaging, data, and other fees may apply. Some Mobile Features may be restricted or incompatible with your carrier or device. Contact your carrier for more information. As applicable, instructions for opting out of Mobile Features will be provided, typically requiring you to text a keyword (e.g., “STOP”) to a short code or change your profile settings on the Application and/or Website.

You are responsible for ensuring that the latest version of the mobile OS is installed, the Application is up to date, and your mobile device is not jailbroken or rooted. You will be held responsible and accountable in the event of any breach of your obligations or your mistake.

Mandatory Removal of Content and Services

If you violate any of these Terms and Conditions, your permission to use our Website(s) and/or Application(s) automatically terminates and you must immediately destroy any copies you have made of any portion of the content.

10.Intellectual Property

Nothing in these terms and conditions shall be construed as granting you any sort of license or right to use any trademark, logo or service owned by us and/or third parties.

Except as expressly provided in these Terms and Conditions, no content may be copied, reproduced, republished, posted, publicly displayed, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

11.Confidentiality

By using the Online Channels you agree that we shall have access to all your personal data including name, email address, phones number, home address, national ID/residency number. We hereby confirm that such data will remain confidential and will not be disclosed to any third party unless required by applicable regulations, business needs, providing services, legal cases, or after obtaining your prior consent.

12.Data Privacy

By using our Website(s) and/or the Application, you consent to the collection and use of your personal data and Users’ personal and sensitive personal information/data in accordance with our Privacy Policy. By using our Website(s) and/or Application(s), you agree to our Privacy Policy. We reserve the right to modify or update Privacy Policy at any time. Your continued use of our Website(s) and/or Application(s) after changes to the Privacy Policy constitutes acceptance of those changes.

When you use action-oriented features on our Website(s) and/or Application(s), you agree that GIG/Jordan may send you notifications via email, SMS, or other contact information you provide. These notifications may include personal and sensitive information, You understand and agree that by using these features, you are opting to receive your own protected information by email, SMS, or mobile telephone notification, which might not be secure, and You will be charged by your wireless or internet provider for these messages, which may be sent by an automated system. If you prefer not to receive personal information by email or mobile notification, update your account notification settings.

13.Communication

GIG/Jordan or its affiliates may contact you by short messages, calls, and/or emails from time to time regarding your account, Insurance Policies, and/or the Insurance Services to provide service announcements, privacy notices, administrative messages and other communications.

By agreeing to these Terms and Conditions and providing your telephone number and email address to us and/or our affiliates, you: (i) consent to receive short messages, calls and/or emails from or on behalf of GIG/Jordan or any of its affiliates; and (ii) acknowledge and agree that your information may be processed in accordance with, and you are to be bound by, our Privacy Policy.

14.Termination of Services

Without prejudice to our rights under these Terms, We reserve the right to terminate or suspend your account, Insurance Polic(ies), and/or Insurance Services under certain circumstances, including but not limited to, violations of these Terms and Conditions, Privacy Policy, and/or any other relevant terms and conditions.

15.Limitation of Our Liability

Our Online Channels are provided on an “as is” and “as available” basis, with all faults. We hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and not infringement. We do not make any warranty that (1) Our Online Channels will be error free or that access thereto will be continuous or uninterrupted, timely, or secure (2) Our Online Channels will meet your requirements or expectations, (3) Any information or content obtained through our Online Channels will be accurate, reliable, complete, or current, (4) Any defects or errors will be corrected; and/or Our Online Channels or the servers that make them available are free of viruses or other harmful components. Your use of our Online Channels is at your sole risk. You acknowledge that any material or data downloaded or otherwise obtained through the use of our Online Channels is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material or data.

16.Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Hashemite Kingdom of Jordan. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved through the Central Court of Amman (the Palace of Justice)/ Jordan.

18.General Provisions

 

  • Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our control.
  • Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: The failure to enforce any provision of these Terms and Conditions does not waive our right to do so later.
  • Notwithstanding anything to the contrary contained herein, we reserve the right to, in our sole discretion and without notice or liability, deny access to the use of our Online Channels, to any person.
  • If we terminate our contractual relationship with you and/or you become prohibited from using our Online Channels, you are prohibited from using the Online Channels under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
  • In addition to what is stated under this subparagraph, we reserve the right to take appropriate legal action against you, including without limitation pursuing civil and/or criminal lawsuits and seeking indemnification.
